GENEVA, September 07 (KUNA) -- Chairman of the Board, Public Authority for Assessment of Compensation for Damages resulting from the Iraqi Aggression (PAAC) Khaled Ahmad Al Mudhaf announced to the 66th UN Compensation Commission (UNCC) of the Governing Council that on July 10, 2008, the Kuwait National Focal Point selected the entity which will be responsible to perform the work of the Project Planning and Supervision Consultant (PPSC). "The Kuwait NFP selection was in concurrence with the recommendation made by the Technical and Financial Proposal Review Committees which were convened by Kuwait NFP to review, evaluate and recommend the most suitable entity capable to execute the detailed and complex terms of reference," he added.
Al Mudhaf said that the PPSC is responsible to prepare the Kuwait Master Plan for the UNCC awarded environmental remediation projects. "The task requires the analysis, design and development of detailed technical terms of reference for each project or sub-unit of projects that will be subject to environmental remediation. Currently, Kuwait NFP is awaiting the approval from the relevant control organizations within Kuwait Government to proceed with the final signing of the PPSC contract," he added. He said that Kuwait NFP will continue to inform the honorable Governing Council of the progress and development as related to its environmental remediation projects.
"With respect to the issue of creation of a special account to manage funds withheld under decision 258, Kuwait National Focal Point (Kuwait NFP) has submitted its response on 8 September 2008 to the letter received from the UNCC on 7 August 2008. The response includes detailed answers from the various financial institutions in Kuwait. In the response, the official view of the Government of Kuwait was also conveyed which aims to maintain the funds within an account managed by the United Nations," he said. He stressed that Kuwait would like to bring to the attention of the Governing Council that the proposed account should include only amounts allocated for the environmental remediation projects irrespective of the size of the awards. "Amounts related to Kuwait NFP Administration Expenses, including that of the Independent reviewers, must be isolated from the proposed account," he added. Al Mudhaf said that the State of Kuwait has followed with interest the Governing Council continued consideration of the arrangements for ensuring that payments are made to the Compensation Fund and the related issue of the shortfall to the Fund. Given that the mandate of the International Advisory and Monitoring Board (IAMB), extended by Security Council Resolution 1790 (2007), is scheduled to expire on 31 December 2008 and the Iraq Committee of Financial Experts would take over as the successor body to oversee the Iraqi oil export revenues. "The State of Kuwait requests the Governing Council to take necessary steps to ensure that the current arrangements for payments into the Compensation Fund will continue to apply. The State of Kuwait thanks the Governing Council and the Secretariat for their efforts in this regard," he said. Al Mudhaf added that an issue of importance to the Region as well as to the UNCC, is the first RERAG meeting Point Technical Meeting from 27-29 May 2008 organized by the Kuwait National Focal, which was attended by representatives from the Islamic Republic of Iran, the Republic of Iraq, the Hashemite Kingdom of Jordan, the State of Kuwait, and the Kingdom of Saudi Arabia. "The meeting was presented with the latest developments in the Regional Environmental Remediation Databank which will be shared by all participating countries and part of which will be open to public use. The participants also examined the various analytical capabilities of the Central Environmental Laboratory in Kuwait which will be made available for use by RERAG members," he added. Al Mudhaf said that during this 1st Technical Meeting, the participants jointly developed a Draft Regional Work Plan for the coming two years, aiming at identifying areas of regional cooperation. "The work plan will be finalized by the member countries including the Republic of Iraq, in the 2nd Technical RERAG Meeting to be held in Kuwait on 22-23 October 2008, this work plan will be presented to the 7th RERAG meeting which will be held on 30-31 October 2008 in Jordan," he added. Al Mudhaf said that furthermore, the 1st technical meeting considered a Proposal for Iraq`s Rapid Environmental Assessment and Health Study. "This proposal was prepared by Kuwait NFP and presented to the Iraqi delegation. The proposal will be further discussed and developed bilaterally in the 2nd Technical RERAG Meeting, in view of reaching a finalized plan of action to be presented to the RERAG meeting in Jordan," he said. Al Mudhaf noted that on the issue of direct consultation with Iraq, the Government of the State of Kuwait reaffirms its position that any discussion on the unpaid awards that will remain outstanding after the payment of the Category (2) claims as per decision 256, should be addressed only under the auspices of the UNCC. We have informed the UNCC Officer-in-charge of our willingness to meet with the representatives of the Government of the Republic of Iraq at any convenient time. "We hope that such discussion will pave the way for the Governing Council to establish an equitable payment mechanism for the approximately USD 24 billion which will remain unpaid after the completion of the payment of Category (2) claims as per decision 256," he stressed.
Al Mudhaf thanked the UNCC for disbursing compensation amounts on 29 April and 29 July 2008, in accordance with Decision 256.
"Kuwait also welcomes that the Governing Council at its sixty-fifth session in April 2008 affirmed its conclusion taken at the sixty-fourth session which maintained the level of contribution of Iraq to the Compensation Fund at 5 percent. Maintaining the current level of percentage assures the claimant countries of the Governing Council`s commitment to the full implementation of the environmental remediation projects," he stressed.
